1. Agreement to Terms
By accessing and purchasing from the ArohaKiri website ("the Site"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you, the user, and ArohaKiri. If you do not agree with any part of these terms, you must not use or make purchases from our Site.
2. Products and Orders
ArohaKiri sells skirts, dresses, and T-shirts online. All product descriptions, images, and prices are subject to change without notice. We reserve the right to limit sales, discontinue products, or correct errors in pricing or product information. Your placement of an order constitutes an offer to purchase, which we may accept or decline at our sole discretion.
Upon order confirmation, you will receive an email to [email protected]. We are not responsible for orders lost due to incorrect email addresses provided by the customer.
3. Limitation of Liability
To the fullest extent permitted by applicable law, ArohaKiri, its directors, employees, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your access to or use of, or inability to access or use, the Site or any products purchased therefrom.
This includes, but is not limited to, damages for loss of profits, data, or other intangible losses, even if we have been advised of the possibility of such damages. Our total cumulative liability to you for all claims arising from or related to the Site or these terms shall not exceed the amount you paid to ArohaKiri for the products in the transaction giving rise to the claim.
4. Intellectual Property Protection
All content on the ArohaKiri Site, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the exclusive property of ArohaKiri or its content suppliers and is protected by international copyright, trademark, and other intellectual property laws.
The "ArohaKiri" name and logo, and all related product and service names, design marks, and slogans are trademarks of ArohaKiri. You are not permitted to use any of these marks without our prior written consent. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information or content obtained from the Site.
5. Refund & Return Policy
We want you to be completely satisfied with your purchase. If you are not satisfied, you may return eligible items within 30 days of delivery for a refund or exchange, provided the items are unworn, unwashed, and in their original condition with all tags attached.
- Refunds: Once we receive and inspect your return, we will notify you via email. If approved, a refund will be processed to your original method of payment within 10 business days. Shipping costs are non-refundable.
- Non-Returnable Items: Gift cards, final sale items (clearly marked), and personalized products are not eligible for return.
- Initiating a Return: To start a return, please contact our customer service team at [email protected] with your order number and details about the product you would like to return.
We are not responsible for return shipping costs or items lost in return transit. We recommend using a trackable shipping service.
6. Governing Law
These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of New Zealand, without regard to its conflict of law principles.
